The ruling on one who performs tayammum in the presence of water

Q96: The questioner says: There are people who, despite the presence of water, perform tayammum and pray with it constantly. I have advised them several times, but my advice has no effect on them. Is the prayer valid in this manner? Please inform us, may Allah reward you.
A96: Tayammum is a substitute for purification with water, and it is not permissible except for a valid religious excuse. The first case is when one is devoid of water, or when one has only a small amount of water that is insufficient for his needs, in which case he keeps the water for his needs and performs tayammum. The second case is when one is unable to use water, despite its presence, due to an illness that prevents him from using it, or because using it is difficult for him in a state of illness; in this case, he performs tayammum. This is based on the saying of Allah the Exalted:[Al-Ma'idah 5:6]
The noble verse indicates that tayammum is not permissible except in two cases: The first case is when a person is ill and unable to use water. The second case is when a person is traveling and has no water with which to perform wudu or ghusl from janabah, or when he has only a small amount of water that is insufficient for his needs and purification. In these two cases, one resorts to tayammum. However, if one performs tayammum without a valid religious excuse, while water is present and he is able to use it, then it is not valid, and his prayer is not valid; because he prayed without purification. This is based on the saying of the Prophet (peace and blessings be upon him):Sunan Abi Dawud 60Sahih (Al-Albani) And because Allah (Glorified and Exalted is He) conditioned in this verse the precedence of purification with water for prayer in the manner He mentioned in this noble verse. لا يقبل الله صلاة أحدكم إذا أحدث حتى يتوضأtheir prayer is not valid for the entire duration.
