The Shaykh : If she is of age, it is obligatory, and if she is not of age, the matter returns to her guardian; he is the one who marries her off. However, if she has reached the age of accountability, it is obligatory to consult them and take their opinion, and it is not permissible to force them against their will except with their consent. You may know the saying of the Prophet (peace and blessings be upon him) regarding the virgin, where he said:
Her permission is her silence وإذنها صماتها
; therefore, permission must be sought, and the guardian must not have opposed the Prophet and committed a sin that may have many serious consequences later, such as discord arising between the spouses. In that case, the guardian who married off the girl of age bears the responsibility; either she was forced, or she was not of age and he did not make a good choice. If she reaches the age of discernment and accountability while with her husband and then desires separation afterwards, the Shari'ah separates her from her husband; because she was married off while not having reached the age of accountability. Likewise, if she was forced, the Shari'ah separates her from her husband.
