The questioner : I hope you will answer this question, as I am in urgent need of hearing the answer, because I am living in constant torment. I have been married for a year and two months and have not been able to live with my husband or love him because of many traits in him that I do not like and for which I have found no solution. What torments me is that as long as I have not been able to live with him until now, I cannot have him as a husband, nor can I be the righteous wife that any man would wish for. On the contrary, I will be the disobedient wife that I do not wish for. I am, praise be to Allah, a religious woman, but I cannot, and Allah knows that I have tried but failed. From the first day we were married, I did not love him and could not bear him. But I tried not to rush and to be patient. A year and two months have passed since my marriage and nothing has changed. If you tell me to live with him and be patient, I will commit sins against him, and I do not need those sins and burdens. I will not bear this man. Should I ask for divorce? Especially since we have not been blessed with children. Guide me, O honorable Shaykh, for I will follow your guidance.

The Shaykh : I say that this situation may happen to many women; there is no compatibility between her and her husband, and she fears that she will not fulfill the limits of Allah the Exalted regarding him. This occurred in the time of the Prophet (peace and blessings be upon him), so the wife was offered the option to return the mahr to her husband. She accepted, so the Prophet (peace and blessings be upon him) ordered the husband to accept the mahr and divorce her. That was the wife of Thabit ibn Qays ibn Shammus (may Allah be pleased with him). She came to the Prophet (peace and blessings be upon him) and said: "O Messenger of Allah, I find no fault in Thabit ibn Qays in his character or his religion, but I dislike disbelief in Islam", meaning she wanted to separate from him because she feared disbelief in Islam. The scholars said that by her saying "disbelief in Islam," she meant ingratitude toward the spouse, not disbelief in Allah Mighty and Majestic. Therefore, she said: "disbelief in Islam", and it is not possible for there to be disbelief in Islam except minor shirk. So the Prophet (peace and blessings be upon him) said to her:
Will you return his garden to him? أتردّين عليه حديقته؟
She said: Yes. He ordered him to accept it and divorce her. If patience with the husband becomes difficult and the woman fears that she will not uphold the obligatory limits of Allah regarding her husband, there is no harm in her asking for divorce. This problem has become common in recent times, and its cause, Allah knows best, is that each of the spouses does not fulfill the rights of the other, so hearts become repelled, and cursing and swearing increase, and it may extend to cursing the fathers and mothers, may Allah protect us from that. It may also lead to beating that is not permitted by the Shari'ah, resulting in disagreement and conflict. My advice to both spouses is to fear Allah Mighty and Majestic in themselves and in their partner, and to fulfill the rights of the other. If Allah the Exalted knows that they want to reconcile, He will bring about reconciliation between them. Yes.
