The questioner : He says: My father (may Allah have mercy on him) helped me and one of my brothers with our marriages, but my other brothers, as far as I believe, are capable and did not ask him for anything, and they are now saying: His help to you is a debt upon you. Please give us a ruling, may Allah reward you with good?

The Shaykh : The claim that his help to his poor son in marriage is a debt upon him is a false statement with no validity. This is because providing for one’s children in marriage is part of the obligatory maintenance (nafaqah) in a good manner. Since Allah has made them wealthy, they do not need their father to marry them. Accordingly, if a man has a son who is twenty years old and needs to be married, and a son who is ten years old and does not need to be married, and he marries the older one and gives nothing to the younger one, is he being fair between his children? The answer is: Yes, he is fair. What he gave to marry the older son is not a debt upon the older son; rather, it is maintenance that the father provided, for which he is rewarded and granted reward. Spending on your son is charity. The Prophet (peace and blessings be upon him) said to Sa'd ibn Abi Waqqas:
You will be rewarded for whatever you spend for Allah's sake even if it were a morsel which you put in your wife's mouth. واعلم أنك لن تنفق نفقة تبتغي بها وجه الله إلا أجرت عليها حتى ما تجعله في فم امرأتك
Sahih al-Bukhari 56
Even what you put in your wife’s mouth is a reward for you, if you seek thereby the Face of Allah. Therefore, the father is not sinful if he marries his poor son and does not marry his wealthy sons, and the son who was married does not owe a debt. It remains to be asked: Is it permissible for the father to bequeath an amount similar to the mahr he gave to marry his poor son to his younger children who had not reached marriageable age during his lifetime? The answer is: No. It is not permissible, contrary to what some people understand, that if he marries his older sons, he should bequeath to the younger ones an amount similar to what he gave to marry the older ones. This is a mistake, and this bequest is not executed. What he bequeathed to his younger children to marry them with enters into the estate and is distributed according to the shares prescribed by Allah (Mighty and Majestic). Yes.
