Machine translationRead the Arabic original
Question:
This wife, who has indicated her name as (H. M. M), says: She is an Egyptian woman residing in Makkah al-Mukarramah, and this problem is troubling her. She says: I married a committed young man without my mother’s consent, after she had initially agreed to the proposal. In fact, she came to see me and blessed it, but she changed her mind because someone slandered me to her. For this reason, she refused to complete the marriage and wanted to annul this proposal, but my husband and I got married...

The Shaykh:
Repeat... Repeat...

The presenter: She says: I married a committed young man without my mother’s consent, after she had agreed to the proposal and even attended it and blessed it, but she changed her mind in the end because someone slandered me to her. For this reason, she refused to complete the marriage and wanted to annul this proposal, but we got married hoping that she might change her mind as time passed. However, four years have passed, and my husband is striving to reconcile her, but she refuses. Her only request is that he divorce me. I now have nearly two children, and we are living a good life with my husband. What is the ruling on this matter, and is my husband considered undutiful?

Answer:
If the marriage is lawful, there is no blame on him, and he is not undutiful. It is obligatory for her to help him with the marriage and not to prevent him from marrying, if the wife is sound in her religion. The mother has no right to prevent him.
The point is that if the marriage is lawful and there is no objection to it, then he has done well, for in that lies the preservation of his chastity and hastening to what Allah has prescribed. It is obligatory for her to repent to Allah, not to prevent him from marrying, and not to order him to divorce his wife except for a valid reason.
As for if the wife is not satisfactory in her religion, there is a perspective for that. If the questioner, who is the wife, is not satisfactory, and her mother wants him to be rid of her because she is not satisfactory in her religion due to her open sinfulness and sins, or because she is accused of corruption, then there is a perspective for that. He should obey his mother in that and part with the wife who has no good in her regarding her bad deeds.
The conclusion is that marriage is a sought-after matter. The son must marry even if his parents refuse. He must marry and preserve his chastity, and they must help him. His parents must help him. But if the proposed bride is not righteous in her religion, it is obligatory for him to seek someone else and not disobey his parents. Yes.

The presenter: May Allah reward you with good, O Shaykh.
