The questioner : He says: Men and women who performed the farewell tawaf before Fajr, then slept in the Haram due to extreme fatigue until the Fajr adhan, then performed wudu, prayed, and traveled: is there anything required of them?
The Shaykh : If sleep overcame them involuntarily, I hope there is nothing required of them. However, if they were able to continue but chose to rest, it is as if they did not perform the farewell tawaf. But if a person performs the farewell tawaf, then the adhan for Fajr is called, and he waits and prays, there is no harm in that. This is because the Prophet (peace and blessings be upon him), when he returned from the Farewell Pilgrimage, performed tawaf around the House before Fajr, then prayed Fajr and left.
The questioner : What is required of them?
The Shaykh : We said: If sleep overcame them to the extent that they could not control themselves, there is nothing required of them. Otherwise, they are like those who did not perform the farewell tawaf. And whoever does not perform the farewell tawaf must, according to the scholars, pay a fidyah (ransom payment) by slaughtering an animal in Makkah and distributing it to the poor.
