The Shaykh : The question: There is a young woman who says that a man who is upright upon the Shari'ah has proposed to her, but her father refused and swore an oath that he would disown her until the Day of Resurrection if she married a religious young man—seeking refuge in Allah!—knowing that many young men who are not religious have proposed to her. Is this girl considered sinful if she accepts a young man who is not upright, while she is upright? And does she thereby contradict the hadith of the Messenger of Allah (peace and blessings be upon him) regarding not marrying one whose religion and character she does not approve of?
Answer: It is not permissible for that father to swear such an oath over her; because it is a sinful oath. If she is able to marry through the Shari'ah court, there is no sin on her in marrying the religious young man. One like her should bring her case to the Shari'ah court when the matter becomes serious and the young man proceeds to marry her—he is a good, upright man, as stated in the question—but her father refuses to marry her to him. In that case, she should complain and bring her case to the Shari'ah court. In this situation, the Shari'ah judge takes charge of marrying her to the young man after summoning her father to understand from him that his refusal is not for a Shari'ah reason. In this case, the Shari'ah judge acts on behalf of her father to marry her to that good, upright young man. There is no sin on her in this case; rather, the sin of that father is upon himself.
