The questioner : Then regarding the funeral prayer, the prayer for the deceased, one person died but he was a drinker of intoxicants, what is the ruling on praying over him?

The Shaykh : It is obligatory for some people who are role models in the society to refrain from praying over him, but for the rest of the people, it is obligatory for them to pray, because among the beliefs of the Muslims, which the later generations inherited from the earlier generations, is that "it is obligatory to pray behind every righteous person and every open sinner, and it is obligatory to pray over every righteous person and every open sinner." However, it came in some hadiths that the Prophet (peace and blessings be upon him) refrained from praying over some people and said to his companions, "Pray over him," while he himself refrained from praying over him. In this lies a profound wisdom: he ordered the Muslims to fulfill their duty of praying over him, and he refrained from praying over him to make it clear to the people that what he was doing was something he should not have done. Therefore, in a case like this, where a man who drinks intoxicants dies, leaving behind the prayer, it is not permissible for everyone to rush to pray over him as if he were one of the righteous Muslims. It is obligatory for some of those who are considered to be among the people of knowledge and the role models to refrain from praying over him and to inform the people of the reason for the refraining, because he was an open sinner.
