The questioner: His EminenceThe Shaykh : What is your opinion of one who leaves Mina during the daytime on the days of Tashriq, but returns to spend the night there? Does this action invalidate any of the rites of Hajj?

The Shaykh : What I believe is that the Muslim must adopt the principle I mentioned earlier, which is to do every action the Prophet (peace and blessings be upon him) did, except out of need or to remove hardship from himself. As for taking the rites, or some of them, as a matter of personal preference, so that it is pleasant for him to stay under air conditioners and coolers, and to have the best of food and drink and the like, this is not a characteristic of Hajj nor part of its nature. We must stay in Mina on these days and not leave it except out of need. Otherwise, the norm is to remain here day and night. Although the overnight stay is the most important, as some hadiths indicate, which state that the Prophet (peace and blessings be upon him) went to Makkah, prayed some of the prayers, then returned and spent the night in Mina. However, this distinction made by some people, where they are lenient in spending the day outside Mina, while the overnight stay is at night, we do not know any basis for this distinction in the Sunnah. Therefore, all good lies in following the Prophet.
