The questioner : From Abd al-Salam Saffar in Jeddah. We received this message, which says: It is known that the pilgrim is required to stay overnight in Mina on the days of Tashriq, but if a person does not want to sleep at night, is it permissible for him to go outside Mina and remain all night in the Haram, for example, to perform more acts of worship? May Allah guide you?

The Shaykh : Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions. What is meant by the statement of the scholars that staying overnight in Mina on the nights of the days of Tashriq is obligatory is that one remains in Mina, whether he is sleeping or awake.

The questioner : Yes.

The Shaykh : It is not meant that he must be sleeping only. Therefore, we say to the brother: It is not permissible for you to remain in Makkah on the nights of the days of Tashriq; rather, it is obligatory for you to be in Mina.

The questioner : Yes.

The Shaykh : Yes, except that the scholars say that if one spends most of the night in Mina, that suffices him.

The questioner : This is if he is able, of course, to remain in Mina, for example, due to severe crowding or?

The Shaykh : And he is not allowed to go to Makkah either. Rather, we say: If you are unable to be in Mina, look for the last tent among the tents of the pilgrims and be with them, because it is obligatory that the pilgrims be connected and that some of them be next to others.

The Shaykh : As we say, for example, if the mosque is filled with the congregation, the people line up next to one another. Yes.
