Question: This is a person who left 'Arafah, then stoned the first pillar, then performed the circumambulation and the sa'y, so he sat in a residence in Makkah until the 'Asr prayer, then he returned to Mina and slaughtered his sacrificial animal. Does he owe anything for this sitting?

Answer: There is no blame on him for that. Whoever sits in Makkah during the day on the Day of Sacrifice or on the Days of Tashriq, in his house or with some of his companions, there is no blame on him for that. Rather, the better is to remain in Mina if that is facilitated; following the example of the Prophet (peace and blessings be upon him) and his Companions (may Allah be pleased with them). If that is not facilitated for him, or it is difficult for him, and he enters Makkah and stays there during the day, then returns to Mina at night and spends the night there, there is nothing wrong with this and no blame.
As for the stoning on the Days of Tashriq, it is to be done after the sun passes its zenith, and it is not permissible before that. Whoever stones at night, there is nothing wrong with it on the day the sun has set, not on the following day, if the stoning after the sun passes its zenith was not facilitated for him. If it is facilitated before sunset, that is better.
