The Shaykh : And of the punishment of the grave. Is there punishment in the grave? Yes, there is punishment in it. There is eternal punishment for the disbelievers. And there is punishment that may be eternal or may not be eternal for whom? For the sinners among the believers. The Prophet (peace and blessings be upon him) passed by two graves and said:
They are being punished but they are not being punished for anything that was difficult to avoid. One of them used not to take care to avoid getting urine on his body or clothes إنهما ليعذبان وما يعذبان في كبير أما أحدهما فكان لا يستبرئ من البول

He was negligent and did not wash his urine when it affected him.
and the other used to walk about spreading malicious gossip. وأما الآخر فكان يمشي بالنميمة

. Talebearing is conveying people's words from one to another to sow enmity and hatred between them. It is among the major sins, to the extent that the Messenger (peace and blessings be upon him) said:
The beater of false tales would never enter heaven. لا يدخل الجنة قتات
Sahih Muslim 105b
. And the qatatt is the talebearer, may Allah protect us. And Allah the Exalted said:
(10) And do not obey every worthless habitual swearer (11) [And] scorner, going about with malicious gossip - (12) A preventer of good, transgressing and sinful, (13) Cruel, moreover, and an illegitimate pretender. ولا تطع كل حلاف مهين هماز مشاء بنميم مناع للخير معتد أثيم عتل بعد ذلك زنيم
[Al-Qalam 68:10-13]
. So talebearing is among the major sins. A man comes to another man and says: So-and-so is saying such and such about you, in order to sow enmity between them. You will find the talebearer ruining the relationship between a man and his wife, between a brother and his brother, between a father and his son, and between tribes, ruining, may Allah protect us, what no one knows except Allah through his talebearing. For this reason, talebearing became a cause for the punishment of the grave, as the Messenger (peace and blessings be upon him) said.
Then, in the hadith of Ibn 'Abbas:
He took a fresh branch, split it in two, and stuck one in each grave. They said: What did you do, O Messenger of Allah? He said: Perhaps it will alleviate the punishment for them as long as they do not dry out أخذ جريدة رطبة فشقها نصفين فغرز في كل قبر واحدة فقالوا : لم صنعت هذا يا رسول الله ؟ قال : لعله يخفف عنهما ما لم ييبسا
This means that the Messenger hoped that Allah would alleviate the punishment for them, cutting it off, alleviating it for them as long as they did not dry out, meaning only for this duration. Some people derived a ruling from this and erred in their derivation from this hadith. They said: One should place a green branch or a tree or something similar on the grave. What do you say about this derivation from this hadith? We say: This is an erroneous and invalid derivation, because the Messenger (peace and blessings be upon him) did not place that on every grave. He only placed it on two graves about which he was informed. Were you informed about this grave so that you would place it on it? No. Then we say: If you place this branch on a man's grave, you have accused him of being punished in his grave and have thought ill of him. If you had placed it on your father's grave, this would be undutifulness and ill treatment of your father, as if you were saying to people: Bear witness that my father is a sinner being punished in his grave. I seek refuge in Allah. Be careful, my brother. So this person who derived the ruling from this hadith erred in two ways: in his derivation from the Sunnah, and in his ill opinion of the owner of this grave. All right.
