The questioner : May Allah forgive you. If one reaches the miqat on the eighth day, is it permissible for him to perform tamattu'? And if it is permissible, is tamattu' or qiran better?

The Shaykh : If he reaches the miqat on the eighth day before the midday prayer, I do not think he should perform 'Umrah, because Allah says:
whoever performs 'umrah [during the Hajj months] followed by Hajj فمن تمتّع بالعمرة إلى الحجّ
[Al-Baqarah 2:196]
Therefore, there must be a time interval between 'Umrah and Hajj. When a person reaches the miqat after the time for Hajj has entered, he is commanded to go out to Mina, to perform the sa'y for Hajj, and to complete it. Based on this, I think it is better for the one who passes the miqat at the time when people go out to Mina to perform qiran and not to perform tamattu', because the time for tamattu' has actually passed, since Allah says:
whoever performs 'umrah [during the Hajj months] followed by Hajj فمن تمتّع بالعمرة إلى الحجّ
[Al-Baqarah 2:196]
This indicates that there is a separator and a time interval between 'Umrah and Hajj. We say: If you want to have both Hajj and 'Umrah, perform qiran, for qiran results in both Hajj and 'Umrah, based on the saying of the Prophet (peace and blessings be upon him) to 'A'ishah:
Your tawaf of the House and of al-Safa and al-Marwah suffices for your Hajj and your 'Umrah. طوافك بالبيت وبالصّفا والمروة يسعك لحجّك وعمرتك
