The Shaykh : It is well known that the mutamatti' exits the state of ihram by performing 'Umrah: he performs tawaf and sa'y, shortens his hair, and exits ihram. So if he entered the state of ihram for Hajj on the eighth day and went out to Mina, it does not benefit him if he performed sa'y before that, because the sa'y of Hajj is not permissible to be performed before the standing at 'Arafah and Muzdalifah, except if he is a qarin or a mufrid and he performed sa'y after the tawaf of arrival.
And based on this, tell the man who did this: tell him that he must now avoid his wife if he has one, and it is obligatory for him to travel to Makkah and perform the sa'y, because he performed sa'y at a time when it was not permissible.
