A man came to perform Hajj as a Mutamatti' and performed 'Umrah, then he went to Jeddah. On the eighth day, he came to Makkah and performed Tawaf with the intention that the Sa'y would be waived for him on the day of 'Eid. Will it be waived for him or not?
It is known that the Mutamatti' becomes in a state of Ihram release by 'Umrah; he performs Tawaf, Sa'y, and shortens his hair, and then he exits the state of Ihram. So, if it is the eighth day, he enters the state of Ihram for Hajj and goes to Mina. It does not benefit him if he performs Sa'y before that; because it is not permissible to perform the Sa'y of Hajj before standing at 'Arafah and Muzdalifah, unless he is a Qarin or a Mufrid and he performed Sa'y after the Tawaf of Arrival. Based on this, tell the man who did this: tell him that he should now avoid his wife if he has one, and it is obligatory for him to travel to Makkah and perform the Sa'y; because he performed Sa'y at the wrong time. It is better for him to enter the state of Ihram for 'Umrah when he reaches the Miqat, and perform Tawaf, Sa'y, and shorten his hair, and then perform the Sa'y of Hajj. Convey this to him, my brother!
