The questioner : He says in this question: “I present to you, O honorable Shaykh, my problem with my wife. I married two years after my father’s death (may Allah have mercy on him), and my father left a trust in my neck: my mother and my young, minor brothers, and I am their sole provider after Allah, Mighty and Majestic. I proposed to my wife on the condition that I would not provide her with a separate house due to my specific circumstances, as I mentioned earlier, and her family agreed to my condition, and the marriage took place. After six months of marriage, my wife began to create problems regarding a separate house for her, knowing well that I cannot afford it due to my circumstances and limited income, as I work for a salary of one thousand riyals per month. She gave me the choice between my mother and her, and she went to her parents’ home without any regard for my feelings. Allah blessed me with a son from her, and they prevented me from visiting him. I am trying to bring her back to my home by all means, but to no avail. Now I am confused, O honorable Shaykh: should I choose my mother who raised me, or this wife, or my son? Please advise us, may Allah reward you.”

The Shaykh : Since there was a condition in your contract that you would not provide her with a separate house, your case is to be referred to the judge, and the judge is the one who will rule between you. I ask Allah for guidance for everyone. You should know what the problems were between your mother and your wife and try to resolve them to the best of your ability, as it may be an easy and simple matter. However, Satan sows discord among people. I see that before resorting to litigation, you should look into the problem; if it can be resolved, that is better. If it cannot be resolved, then there is nothing but to refer the case to the judge. We ask Allah for success for everyone.
