The Shaykh : The mental covenant is what is known to people, as if you wanted to say, "We will go to the judge to litigate before him." Which judge?
The student: The judge of the town.
The Shaykh : The judge of the town is known, so here the person is specified by name. The verbal covenant, yes, is that a mention precedes this matter, meaning for the one you entered upon, a mention such as the saying of Allah the Exalted:[Al-Muzzammil 73:15-16] From which messenger?
The student: Musa (peace be upon him).
The Shaykh : The first one, who is Musa (peace be upon him). So the mosque here is for the mental covenant because it is known to them. "to visit him from nearby" The lam here is for causation, meaning he did that in order to visit him from a nearby place, due to his saying meaning from a nearby place.
This story is about Sa'd ibn Mu'adh (may Allah be pleased with him), the leader of the Aws, as we said. The Banu Qaynuqa were their allies. When... and Qaynuqa had broken the covenant, he asked Allah (Mighty and Majestic) not to let him die until He would satisfy his eye with the Banu Qaynuqa. So Allah answered his supplication. His wound remained closed and did not bleed until the expedition of Banu Qaynuqa took place and they submitted to the judgment of Sa'd ibn Mu'adh (may Allah be pleased with him). They thought it would be like the case of Abdullah ibn Ubayy ibn Salul, that he would ask for pardon and overlook it. But there is a difference between Sa'd ibn Mu'adh and Abdullah ibn Ubayy ibn Salul; the second is a hypocrite and the first is a believer. They submitted to his judgment (may Allah be pleased with him) out of respect for the Prophet (peace and blessings be upon him), , (may Allah be pleased with him), even though they were his allies and custom dictated that he would ask for pardon for them. But because of his faith in Allah (Mighty and Majestic) and His Messenger, he judged with this. The Prophet (peace and blessings be upon him) testified for him that he judged among them with the judgment of Allah from above seven heavens (may Allah be pleased with him). In this narrow, cramped place, he was guided to the right. What happened happened . Allah satisfied his eye with the Banu Qaynuqa, whatever the decision, for he was, what? The judge among them. And this was among the answers to his supplication. And the Throne of Allah (Mighty and Majestic) shook for his soul. In this, the poet says:
"And the Throne of Allah did not shake for a deceased *** Whom we heard of, except for Sa'd, the father of 'Amr".
(May Allah be pleased with him) and gather us and you and him in the abode of eternal bliss.
The student: Amen.
The Shaykh : Until we remind ourselves of this and mention that, if Allah wills.
The student: The judge of the town.
The Shaykh : The judge of the town is known, so here the person is specified by name. The verbal covenant, yes, is that a mention precedes this matter, meaning for the one you entered upon, a mention such as the saying of Allah the Exalted:
just as We sent to Pharaoh a messenger. (16) But Pharaoh disobeyed the messenger

من قريبThis story is about Sa'd ibn Mu'adh (may Allah be pleased with him), the leader of the Aws, as we said. They submitted to his judgment (may Allah be pleased with him)
So the Prophet (peace and blessings be upon him) sent someone to bring him from the mosque to the Banu Qaynuqa, and he was present. When they made him their judge, he said, "My judgment is binding on these people," and he pointed to the Prophet (peace and blessings be upon him), but he had lowered his gaze.
He said, "On these people," meaning on the Banu Qaynuqa. They said, "Yes." The two parties agreed that he would be the judge between them. So he judged that the fighters should be killed, the wealth should be taken as spoils, and the children should be taken as captives.
قال على هؤلاء أي على بني قريظة قالوا نعم اتفق الخصمان على أن يكون هو الحكم بينهما، فحكم أن تقتل المقاتلة وأن تغنم الأموال وأن تسبى الذريةThen he returned to his tent, and blood gushed from his wound, and he died (may Allah be pleased with him).
ثم رجع إلى خيمته فانبعث الدّم من أكحله ومات رضى الله عنه"And the Throne of Allah did not shake for a deceased *** Whom we heard of, except for Sa'd, the father of 'Amr".
(May Allah be pleased with him) and gather us and you and him in the abode of eternal bliss.
The student: Amen.
The Shaykh : Until we remind ourselves of this and mention that, if Allah wills.
