Question: Praise be to Allah, Lord of the worlds, and may peace and blessings be upon the Messenger of Allah (peace and blessings be upon him).
Your Eminence, the distinguished Shaykh, Abdul Aziz ibn Abdullah ibn Baz, may Allah preserve you and protect you
Peace be upon you, and Allah's mercy and blessings. And after that:
I traveled from the Eastern Province (Al-Ahsa) to the Holy Makkah on the occasion of the Eid al-Fitr holiday and took this opportunity for my family and me to perform 'Umrah in the month of Ramadan. We entered the state of ihram from the miqat and went to the Makkah Haram, then we performed tawaf and sa'y. During the second lap of the sa'y, my wife told me: "Blood has come down on me, and it is due to a ligature." She also said: "I felt something slight before entering the Haram, but I did not confirm it; however, now the bleeding is confirmed." I immediately took her to one of the gates of the Haram and asked one of the Shaykhs there. He told me: "She does not complete the sa'y, but you complete the 'Umrah." I asked him to ask whether there is an expiation for you. That was at exactly eight in the morning. After I completed the 'Umrah, I went to the Ifta office in the Haram, but I found no one. One of the people present told me that no one is there now. I took my family and went to my hometown, where I spent the rest of the holiday, then I returned to the Eastern Province. After my return, I asked one of the Shaykhs about it, and he told me: "Your wife is still in a state of ihram, and what is forbidden for one in ihram is forbidden for her, and she is obligated to complete the 'Umrah." Therefore, I ask your Eminence to inform me of the Shari'ah ruling in this matter. If she is still in a state of ihram, she has bathed, had intercourse with me, combed her hair, and cut her nails.
Is there an expiation? Or does the coming down of blood remove the state of ihram from her? Is she obligated to complete the 'Umrah? Or is she considered to have performed 'Umrah since she intended the 'Umrah and this happened after the intention against her will? If it is necessary to complete the 'Umrah, I inform you that I am unable to take her at the present time due to my work circumstances. After the region, this is it, and I ask for your Eminence's Shari'ah opinion, and may Allah preserve you and protect you.
Answer: And upon you be peace, the mercy of Allah, and His blessings. As for what follows:
If the reality is as you mentioned in the question, then the woman mentioned is still in a state of ihram, and you must avoid her until she goes to Makkah and performs tawaf, sa'y, and shortens her hair. By doing so, she completes her 'Umrah. If you had intercourse with her during this period, she must offer a sacrificial animal as a ransom to be slaughtered in Makkah for the poor: a one-year-old sheep or a two-year-old goat that is acceptable for the 'Id sacrifice, along with repentance and seeking forgiveness from both of you. She must also perform another 'Umrah from the miqat in place of this 'Umrah that was invalidated by the intercourse. We ask Allah for guidance and the acceptance of repentance for everyone, and we advise both of you not to be lax in matters of religion and to hasten to seek a fatwa in everything that is difficult for you. We ask Allah for success and guidance for everyone.
In summary: Your wife must complete her 'Umrah by performing tawaf, sa'y, and shortening her hair. Then, if you had intercourse with her, she must perform another 'Umrah from the miqat, along with the ransom mentioned above. And peace be upon you, the mercy of Allah, and His blessings.
