Q: I arrived in the Kingdom by plane and intended to perform 'Umrah at the miqat while we were in the air. When I arrived at Jeddah Airport , I found my husband waiting for me, and he took me to a hotel in the city of Jeddah to rest. Since he was exhausted from the journey, as he had arrived in Jeddah after a long trip all night, he told me that he was unable to go to Makkah , and that, if Allah wills, in two or three weeks we would go to Makkah to perform 'Umrah. So I agreed with him. After three weeks, we entered the state of ihram from the miqat, and I performed 'Umrah perfectly, praise be to Allah. Then I traveled to my country. My question is: Do I owe anything regarding my first 'Umrah ihram that I did not perform, and how do I make up this expiation while I am in my country now? May Allah reward you with all good.
A : If no sexual intercourse took place during the period you remained in Jeddah , then the 'Umrah is valid and you remain in your first state of ihram, and your second ihram has no value. However, if sexual intercourse did take place during the aforementioned period, then the 'Umrah you performed is defective, and you must return to make it up by entering ihram from the miqat
from which you entered ihram for the first 'Umrah. You must slaughter a sheep in Makkah that is acceptable as a sacrificial animal, to be distributed to the poor of the Haram , and you must not eat any of it. If your husband had entered ihram for 'Umrah when he met you and sexual intercourse took place between you, then he is required to do the same as what we mentioned to you regarding making up the 'Umrah and the obligation of the blood (sacrifice). Any mistake made in wearing sewn clothing or other prohibitions of ihram is excused due to ignorance. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
