The Ruling on Selling and Working in Intoxicants Factories

Question: What is the ruling on a Muslim who sells intoxicants or narcotics? Do we call him a Muslim or not? What is the ruling on a Muslim who works in an intoxicants factory? And is it obligatory for him to leave his job if he finds no other?

Answer: Selling intoxicants and all other forbidden things is among the great evils, and likewise, working in intoxicants factories is among the forbidden things and evils; because of the saying of Allah :
And cooperate in righteousness and piety, but do not cooperate in sin and aggression.وَتَعَاوَنُواْ عَلَى الْبرِّ وَالتَّقْوَى وَلاَ تَعَاوَنُواْ عَلَى الإِثْمِ وَالْعُدْوَانِ
[Al-Ma'idah: 2], and there is no doubt that selling intoxicants, narcotics, and tobacco is cooperation in sin and transgression.
Likewise, working in factories for intoxicants is aiding in sin and transgression. And Allah (Glorified and Exalted is He) said: :
O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan, so avoid it that you may be successful.يَا أَيُّهَا الَّذِينَ آمَنُواْ إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالأَنصَابُ وَالأَزْلاَمُ رِجْسٌ مِّنْ عَمَلِ الشَّيْطَانِ فَاجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ ۝
[Al-Ma'idah 5:90]
Indeed, Satan only wants to bring about between you hostility and hatred through intoxicants and gambling, and to turn you away from the remembrance of Allah and from prayer. So will you not stop? [Surat al-Ma'idah: 90-91].
It is authentic from the Messenger of Allah (peace and blessings be upon him) that he
He cursed intoxicants, its drinker, its server, its presser, its pressed one, its carrier, the one to whom it is carried, its seller, its buyer, and the one who eats its priceلعن الخمر، وشاربها، وساقيها، وعاصرها، ومعتصرها، وحاملها، والمحمولة إليه، وبائعها، ومشتريها، وآكل ثمنها
Sunan al-Bayhaqi 16:11
, and it is also authentic from him, may Allah's prayers and blessings be upon him, that he said:
Indeed, Allah has a covenant with whoever dies while drinking intoxicants that He will make him drink from the mud of the cursedإن على الله عهدًا لمن مات وهو يشرب الخمر، أن يسقيه من طينة الخبال
. It was said: O Messenger of Allah, what is the mud of the cursed? He said:
the juice of the people of the Fireعصارة أهل النار
or he said:
the sweat of the people of the Fireعرق أهل النار
.
As for his ruling: he is a sinner and an open sinner thereby, and his faith is deficient. On the Day of Resurrection, he is under the will of Allah; if He wills, He will forgive him and pardon him, and if He wills, He will punish him if he dies before repenting, according to the people of the Sunnah and the community; because of the saying of Allah, the Exalted:
Indeed, Allah does not forgive association with Him, but He forgives what is less than that for whom He willsإِنَّ اللّهَ لاَ يَغْفِرُ أَن يُشْرَكَ بِهِ وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَن يَشَاء
[An-Nisa: 116].
And this ruling applies if he does not consider it permissible. But if he considers it permissible, he commits disbelief thereby, and he is not washed, nor is the funeral prayer performed for him if he dies while considering it permissible, according to all scholars; because by doing so, he becomes a denier of Allah and His Messenger, may Allah's prayers and blessings be upon him. And likewise is the ruling for one who considers unlawful sexual intercourse, sodomy, or usury or interest permissible, or any other of the forbidden things upon which there is consensus; such as undutifulness to parents, severing family ties, and killing a soul without right.
As for one who commits it or something of it while knowing that it is forbidden, and knowing that he is a sinner against Allah thereby, this does not make him a disbeliever, but he is an open sinner under the will of Allah, the Exalted, in the Hereafter, if he does not repent before death, as mentioned earlier regarding the ruling on the drinker of intoxicants. And success is from Allah.
