Q: A questioner from Gambia asks and says: What is the ruling on a Muslim who sells intoxicants or narcotics? Do we call him a Muslim or not? What is the ruling on a Muslim who works in an intoxicant factory? And is it obligatory for him to leave his job if he finds no other?

A: Selling intoxicants and all other forbidden things is among the great evils, and likewise working in intoxicant factories is among the forbidden and evil things; because of the saying of Allah (Glorified and Exalted is He) :
And cooperate in righteousness and piety, but do not cooperate in sin and aggression.وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى وَلا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ
[Al-Ma'idah: 2]. And there is no doubt that selling intoxicants, narcotics, and tobacco is cooperation in sin and aggression, and likewise working in intoxicant factories is aiding in sin and aggression. And Allah (Glorified and Exalted is He) said :
O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan, so avoid it that you may be successful.يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ فَاجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ ۝
[Al-Ma'idah 5:90]
"Indeed, Satan only wants to cause between you hostility and hatred through intoxicants and gambling, and to avert you from the remembrance of Allah and from prayer. So will you not desist?" [Al-Ma'idah: 90, 91]. And it is authentic from the Messenger of Allah (peace and blessings be upon him) that he cursed intoxicants, its drinker, its server, its presser, its extractor, its carrier, the one to whom it is carried, its seller, its buyer, and the one who eats its price.
And it is also authentic from him (peace and blessings be upon him) that he said:
Indeed, Allah has a covenant upon Himself for whoever dies while drinking intoxicants to make him drink from the mud of corruption.إن على الله عهدا لمن مات وهو يشرب الخمر أن يسقيه من طينة الخبال
It was said: O Messenger of Allah, what is the mud of corruption? He said:
the juice of the people of the Fireعصارة أهل النار
or he said:
the sweat of the people of the Fireعرق أهل النار
.
As for his ruling, he is a sinner and an open sinner thereby, and his faith is deficient. On the Day of Resurrection, he is under the will of Allah; if He wills, He will forgive him and pardon him, and if He wills, He will punish him, if he dies before repenting, according to the people of the Sunnah and the community; because of the saying of Allah, the Exalted:
Indeed, Allah does not forgive association with Him, but He forgives what is less than that for whom He willsإِنَّ اللَّهَ لا يَغْفِرُ أَنْ يُشْرَكَ بِهِ وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَنْ يَشَاءُ
[An-Nisa: 116]. And this ruling is if he does not consider it permissible. But if he considers it permissible, he commits disbelief thereby, and he is not washed and no funeral prayer is performed over him if he dies while considering it permissible, according to all scholars; because by that, he becomes a denier of Allah, Mighty and Majestic, and His Messenger (peace and blessings be upon him).
And likewise is the ruling for one who considers unlawful sexual intercourse, sodomy, usury or interest, or any other of the forbidden things upon which there is consensus, such as undutifulness to parents, severing family ties, and killing a soul without right, permissible.
As for one who does it or any of it while knowing that it is forbidden and knowing that he is sinning against Allah thereby, this does not make him a disbeliever, but he is an open sinner under the will of Allah, the Exalted, in the Hereafter if he does not repent before death, as mentioned earlier regarding the ruling of the drinker of intoxicants. And success is from Allah.
