Question: Peace be upon you, and Allah's mercy and blessings. As for what follows:
Your letter reached me, in which you described the situation of your husband, dated Monday, 14/6/1411 AH, corresponding to 31/12/1990 CE. I understood what you described regarding your husband’s situation: that he claimed to be a Muslim, and for that reason you agreed to marry him, and you have two children from him. However, it became clear to you from his conduct that he mocks Islam and curses it, and says: “Religions are myths.” He does not pray, does not fast, does not pay zakah, does not perform Hajj, drinks intoxicants, and eats pork.

Answer: If you are truthful in what you have mentioned, then the one mentioned is neither a Muslim nor a Christian, but rather a disbeliever, an atheist who has no religion. We ask Allah for your well-being and safety from him. It is not permissible for you to remain with him; rather, it is obligatory for you to ask him for a divorce certificate. Allah will replace him with someone better for you, if Allah wills. This is based on the saying of Allah the Exalted in Surat al-Talaq:
And whoever fears Allah - He will make for him a way outوَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مَخْرَجًا ۝
[At-Talaq 65:2]
and He will provide for him from sources he does not expect [al-Talaq: 2-3], and His saying the Exalted:
And whoever fears Allah - He will make for him of his matter ease.وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مِنْ أَمْرِهِ يُسْرًا
[al-Talaq: 4]. You have more right to your children than he does, because he is a disbeliever and you are a Muslim woman, and the young child follows the better of the two parents in religion. The religion of Islam is the true religion, and all other religions are false. This is based on the saying of Allah (Glorified and Exalted is He) in Surat Ali 'Imran:
Indeed, the religion in the sight of Allah is Islamإِنَّ الدِّينَ عِنْدَ اللَّهِ الْأِسْلامُ
[Ali 'Imran: 19], and His saying the Exalted:
And whoever desires other than Islam as religion - never will it be accepted from him, and he, in the Hereafter, will be among the losers.وَمَنْ يَبْتَغِ غَيْرَ الْأِسْلامِ دِينًا فَلَنْ يُقْبَلَ مِنْهُ وَهُوَ فِي الْآخِرَةِ مِنَ الْخَاسِرِينَ
[Ali 'Imran: 85], and His saying (Glorified and Exalted is He) in Surat al-Ma'idah:
This day I have perfected for you your religion and completed My favor upon you and have approved for you Islam as religion.الْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِي وَرَضِيتُ لَكُمُ الْأِسْلامَ دِينًا
[al-Ma'idah: 3].
And I ask Allah (Glorified and Exalted is He) to keep us and you firm upon Islam, and to make for you a way out from every worry, and an exit from every distress, and to replace this husband with a righteous Muslim husband who is better than him. I also ask Him the Exalted to guide this husband of yours to Islam, and to turn him back to the truth, and to protect him from the evil of his own self, the evil of Satan, and the evil of bad companions. Indeed, He (Exalted and Majestic is He) is Generous and Bountiful, and He is Capable of all things.
And peace be upon you and the mercy of Allah and His blessings.
