Question: If a husband sees nothing but faults in his wife and does not bestow upon her a kind word, and she does not feel safe and secure with him, and she can no longer bear this treatment and has become desperate about improving this relationship. She tried to improve herself by all means to please her husband, but the matters are beyond her control. So, if she asks for divorce, does she fall under the scope of the hadith which means:
If a woman asks for divorce without a valid excuse, she will not enter Paradise and will not smell its scent.إن المرأة إذا طلبت الطلاق بغير عذر لا تدخل الجنة ولا تشم ريحها
? And are the reasons mentioned previously considered in the Shari'ah as permitting divorce, such that she would not be sinful?

Answer : It is obligatory for all husbands to treat their wives with kindness; due to the saying of Allah (Glorified and Exalted is He) :
And live with them in kindnessوَعَاشِرُوهُنَّ بِالْمَعْرُوفِ
[Surat al-Nisa: 19] and His saying (Mighty and Majestic)
And due to the wives is similar to what is expected of them, according to what is reasonable. But the men have a degree over them [in responsibility and authority].وَلَهُنَّ مِثْلُ الَّذِي عَلَيْهِنَّ بِالْمَعْرُوفِ وَلِلرِّجَالِ عَلَيْهِنَّ دَرَجَةٌ
[Surat al-Baqarah: 228], and the saying of the Prophet (peace and blessings be upon him):
Treat women with kindnessاستوصوا بالنساء خيرًا
.
And the evidence for this is abundant. So, if the husband does not do this and mistreats his wife in the manner the questioner described, she has the right to ask for divorce, and she is excused in that. May Allah guide them all.
