Machine translationRead the Arabic original
Question: From Abdulaziz ibn Abdullah ibn Baz, to the honorable brother, the esteemed Judge of Khamis Mushayt, may Allah grant him understanding in all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O Beloved: Your noble letter, number 2959, dated 21/10/1391 AH, has reached us, may Allah guide you. I have reviewed the attached sheet, the text of which is as follows:
(And after: Based on the letter of the esteemed Shaykh, Abdulaziz ibn Abdullah ibn Baz, the husband known to us by identity has appeared before me, the Judge of Khamis Mushayt, and declared, saying: “I divorced my wife, so-and-so, about two years ago by saying to her: ‘You are divorced the number of clover leaves.’ I took her back on the same day. I have four children from her, and I wish to return to marital life. The woman’s guardian—her brother—has also appeared and agreed with the aforementioned son-in-law, saying: ‘What the husband stated is true, and I agree with him regarding the nature of the divorce and his taking back my sister. She is also willing to return to him. Furthermore, I do not object to this if the Shari'ah issues a ruling on it.’ This is what the two mentioned declared, witnessed by those present.” End of text.)
Answer: Based on this, I issued a ruling to the aforementioned husband: that one divorce has taken effect on the aforementioned wife through this divorce, and his taking her back is valid; because it is authentically reported from the Prophet (peace and blessings be upon him) what indicates that such a divorce is considered one divorce. The aforementioned husband must repent to Allah for this; because it is a reprehensible divorce, contrary to the Shari'ah. I hope you will inform everyone of this and warn the husband against returning to such a reprehensible divorce. May Allah reward your efforts, and may He reward you with good for everyone.
And peace be upon you and the mercy of Allah and His blessings.
