Question:
What is the intended meaning, O Your Eminence, of the saying of Allah the Exalted:
Then whoever hastens [his departure] in two days - there is no sin upon him; and whoever delays [until the third] - there is no sin upon himفَمَن تَعَجَّلَ فِي يَوْمَيْنِ فَلاَ إِثْمَ عَلَيْهِ وَمَن تَأَخَّرَ فَلا إِثْمَ عَلَيْهِ
[al-Baqarah: 203]?

Answer:
This noble verse concerns the days of Tashreeq; in the first departure and the second departure, Allah the Sublime says:
And remember Allah during [specific] numbered daysوَاذْكُرُواْ اللّهَ فِي أَيَّامٍ مَّعْدُودَاتٍ
[al-Baqarah: 203]; these are the days of Tashreeq, the eleventh, twelfth, and thirteenth days; the day of the festival is not included among them
And remember Allah during [specific] numbered daysوَاذْكُرُواْ اللّهَ فِي أَيَّامٍ مَّعْدُودَاتٍ
[al-Baqarah: 203].
The day of the festival is included in the ten days in which remembrance is commanded; the ten days are commanded to be filled with remembrance, and the counted days are also commanded to be filled with remembrance; they are all thirteen days, and remembrance is prescribed in all of them from the beginning to the end; from the first day of the month of Dhu al-Hijjah to the thirteenth day, they are all days of remembrance, takbir, and tahlil.
And it is prescribed for Muslims to perform takbir and tahlil in them, at night and by day, in the mosques, in the roads, in the houses, and in every place.
And remember Allah during [specific] numbered days. Then whoever hastens [his departure] in two daysوَاذْكُرُواْ اللّهَ فِي أَيَّامٍ مَّعْدُودَاتٍ فَمَن تَعَجَّلَ فِي يَوْمَيْنِ
[Al-Baqarah 2:203]
; meaning: the twelfth day, so there is no sin upon him,
And whoever delaysوَمَن تَأَخَّرَ
: the thirteenth day
there is no sin upon him - for him who fears Allah. And fear Allah and know that unto Him you will be gathered.فَلا إِثْمَ عَلَيْهِ لِمَنِ اتَّقَى وَاتَّقُواْ اللّهَ وَاعْلَمُوا أَنَّكُمْ إِلَيْهِ تُحْشَرُونَ
[Al-Baqarah 2:203]
; He the Sublime reminded them by this gathering of theirs at 'Arafah, at Muzdalifah, and at Mina, that He will gather them on the Day of Resurrection, so they are gathered to Allah on the Day of Resurrection in a great gathering, not one of them remains, as He the Exalted said:
The Day He will assemble you for the Day of Assembly - that is the Day of Deprivationيَوْمَ يَجْمَعُكُمْ لِيَوْمِ الْجَمْعِ ذَلِكَ يَوْمُ التَّغَابُنِ
[al-Taghabun: 9], so all people are gathered on the Day of Resurrection together, and recompensed for their deeds; if good, then good, and if evil, then evil.
So this gathering at Mina, 'Arafah, and Muzdalifah, this assembly reminds the sensible person of the Day of Resurrection, and the gathering of the creatures on the Day of Resurrection, perhaps he will prepare for that great day.
And among the pilgrims are those who wish to depart and hasten, and those who do not wish that, so whoever hastens from the twelfth day after the sun has passed its zenith and after the stoning, there is no harm, and whoever delays until he stones on the thirteenth day after the sun has passed its zenith, there is no harm, and it is better; because the Messenger (peace and blessings be upon him) delayed and did not depart except on the thirteenth day, peace and blessings be upon him, so the pilgrims are given a choice; whoever wishes may depart on the twelfth day after stoning the three pillars, and he departs to Makkah. Then he is at his option: if he loves to travel, he performs the farewell tawaf before he travels, and if he loves to remain in Makkah for days.
So when he resolves to travel, he performs the farewell tawaf at the time of travel, and the day of the festival is not included among them. So some people make a mistake; they depart on the eleventh day, and say: this is the second day, this is a great error, the day of the festival is not counted among them, the first of them is the eleventh, the Prophet (peace and blessings be upon him) said:
The days of Mina are three, so whoever hastens (leaving after) two days, then there is no sin upon him, and whoever delays, then there is no sin upon him.أيام منى ثلاثة؛ فمن تعجل في يومين فلا إثم عليه، ومن تأخر فلا إثم عليه
