Question: Is it permissible to swear by saying to one's brother, "By your pledge" or "By your prayer," or to say, "It is a burden if you do such and such"? Such customs are widespread among women and children. We ask for guidance. May Allah reward you with good.
Answer: It is not permissible to swear by prayer, nor by pledge, nor by burden, nor by anything else among created things. Swearing is to be done by Allah alone. So one should not say, "By my pledge, I did not do such and such," or "By so-and-so's pledge," or "By so-and-so's life," or "By my prayer." It is also not permissible to ask for such things, as in saying, "Say, 'By my pledge,'" or "Say, 'By my prayer,'" or "By my zakah," or the like. All of this is swearing by other than Allah, and it has no basis in the pure Shari'ah. This is because prayer is the action of the servants, and zakah is the action of the servants, and the actions of the servants are not to be sworn by.
Rather, swearing is by Allah alone or by one of His attributes, based on the saying of the Prophet (peace and blessings be upon him):Sahih al-Bukhari 2679 And his saying (peace and blessings be upon him): Musnad Ahmad 329Sahih (Darussalam) narrated by Imam Ahmad ibn Hanbal (may Allah have mercy on him) with a sound chain from 'Umar (may Allah be pleased with him) . Al-Tirmidhi and Abu Dawud also narrated it with a sound chain from Ibn 'Umar (may Allah be pleased with them both) from the Prophet (peace and blessings be upon him) that he said: Riyad as-Salihin 1711 And he (peace and blessings be upon him) said: Sunan Abi Dawud 3253Sahih (Al-Albani).
It is obligatory for every believing man and woman to be cautious of this and not to swear except by Allah alone , saying, "By Allah, I did not do such and such," or "By Allah, I did not do such and such," when the need arises for it.
It is prescribed to guard one's oath and not to swear except out of need, based on the saying of the Exalted: [Al-Ma'idah: 89]. But when the need arises for an oath, one should not swear except by Allah alone or by one of His attributes, saying, "By Allah, I did not do such and such," or "By the majesty of Allah, I did not do such and such." If he is truthful, there is no blame on him in that. As for swearing by other than Allah, such as by trust, or by the Prophet (peace and blessings be upon him), or by the Ka'bah, or by so-and-so's life, or so-and-so's honor, or by my prayer, or my pledge, all of that is not permissible due to the aforementioned hadiths. However, if he says, "This is in my pledge" or "in so-and-so's pledge," it is not an oath. And success is from Allah.
