The ruling on one who neglects the Fajr prayer and maintains the other prayers

Question:
This questioner says, Your Eminence the Shaykh: A man neglects performing the Fajr prayer because he does not wake up early, but he prays the other obligatory prayers in their times. Is this work accepted from him? And do you have any advice for him? May Allah reward you with good.

Answer:
It is not permissible for a Muslim to be lax in this matter. It is not permissible for him to neglect the Fajr, nor any prayer other than the Fajr. He must maintain all of them in their times with the congregation. He has no right to neglect the Fajr, nor the Zuhr, nor the 'Asr, nor the Maghrib, nor the 'Isha'. Rather, he must maintain all of them in the congregation, in the houses of Allah with his Muslim brothers. If he falls short in this, he is a sinner who imitates the hypocrites, and he deserves to be disciplined by the authorities.
As for if he leaves it entirely, leaving it until the sun rises intentionally, then he commits disbelief in the most correct of the scholars' opinions. We ask Allah for safety. This is based on the saying of the Prophet (peace and blessings be upon him):
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل، وبين الكفر والشرك ترك الصلاة
and his saying (peace and blessings be upon him):
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفر

. So the one who does it intentionally, and sets the time for going to his work after the sun, is intentional. The apparent meaning of the hadith is that he is a disbeliever, and the most correct view is that whoever intentionally leaves one prayer until its time passes commits disbelief. So it is obligatory to be extremely cautious of this evil deed.
And if the cause of that is staying up late, he should not stay up late. He should hasten to sleep so that he is able to rise for the Fajr. The common thing with these people is that they stay up late, so when the Fajr comes, they are dead (asleep). This is a mistake, this is an abomination. So it is obligatory for them to be early so that they sleep a sleep that is sufficient for them, and so that they are able to rise for the Fajr. He should set the time for it, and rise to pray with the Muslims. Yes.
