Question:
The listener, 'Abdullah 'Ali Muhammad, from the industrial area of Yanbu al-Bahr, sent a message containing a collection of questions. In one of them, he asks: Is it permissible to enter Makkah without entering the state of ihram for a non-essential reason, or merely for the purpose of tawaf? And if that is not permissible, who are those who are permitted to enter Makkah without entering the state of ihram?

Answer:
If he intends Makkah for tawaf, or to visit some of his relatives or friends, or for another need, he is not required to enter the state of ihram, and there is no blame on him. This is because the Messenger (peace and blessings be upon him) said, when he designated the miqat boundaries:
and those (Mawaqit) are also meant for those who live at these (places) and for those too who come from without towards them for the sake of Hajj or 'Umraهن لهن، ولمن أتى عليهن، من غير أهلهنن ممن أراد الحج والعمرة
Sahih Muslim 1181a

This is a condition. Therefore, he is not required to enter the state of ihram unless he intends to perform Hajj or 'Umrah. As for one who comes to Makkah for trade, or to visit some of his relatives or friends, or merely to pray in al-Masjid al-Haram and perform tawaf, he is not required to enter the state of ihram, and there is no blame on him for that.
