Question:
The questioner is from the Arab Republic of Egypt and works in Jordan. He has a set of questions. In this question, he says: O Shaykh, what is the ruling on a woman who does not obey her husband in religious and worldly matters? Should he divorce her?

Answer:
It is obligatory for him to advise her, guide her to good, and discipline her with appropriate, light discipline that involves no injury or danger, meaning non-harsh discipline, until she becomes righteous. However, if the discipline and guidance do not benefit, there is no harm in divorce. But he should strive first to discipline her through speech, advice, and guidance, or by boycotting her; he should boycott her in bed and in speech for three days, and in bed for as long as he wishes until she becomes righteous. If the advice and boycotting do not benefit, there is no harm in disciplining her, as He (Exalted and Majestic is He) said:
But those [wives] from whom you fear arrogance - [first] advise them; [then if they persist], forsake them in bed; and [finally], strike them. But if they obey you [once more], seek no means against them.وَاللَّاتِي تَخَافُونَ نُشُوزَهُنَّ فَعِظُوهُنَّ وَاهْجُرُوهُنَّ فِي الْمَضَاجِعِ وَاضْرِبُوهُنَّ فَإِنْ أَطَعْنَكُمْ فَلا تَبْغُوا عَلَيْهِنَّ سَبِيلًا
[Surat al-Nisa: 34]. But it must be a non-harsh beating, a light beating, perhaps she will become righteous. If she does not become righteous, then divorcing her is better if she has not become righteous and has not fulfilled the obligatory duties; then divorcing her is better, with a single divorce, and perhaps Allah will replace her with someone better than her.
As for if she does not pray, it is obligatory to separate from her. If she refuses to pray, then it is obligatory to separate from her, because leaving the prayer is disbelief. We ask Allah for safety.
As for if her disobedience relates to his rights in intercourse, or in cooking food, or in sweeping the house, or the like of that, or in her going out to her family without his permission, these are matters between them. There is no harm if he disciplines her, advises her, guides her to good, and is patient with her.
As for if she is weak in religion, then separating from her is better. The one who does not pray is not permissible to remain with if she does not pray; it is obligatory to separate from her. This is due to the saying of the Prophet (peace and blessings be upon him):
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل، وبين الكفر والشرك ترك الصلاة
And so it is with the woman; the rulings encompass everyone. For this reason, in another hadith, he (peace and blessings be upon him) says:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة، فمن تركها؛ فقد كفر

The matter of prayer is great because it is the pillar of Islam. So whoever leaves it, whether a man or a woman, has committed disbelief. We ask Allah for safety. Yes.
