Question:
A lengthy letter from one of the listening brothers, an Egyptian resident in the Kingdom, who used the initials (M. A. M.) to refer to his name. He says: My father owned a house worth ten thousand Egyptian pounds, and it was sold during my father's lifetime. Then, I traveled abroad ten years ago and accumulated a considerable amount from the fruits of my absence and distance from my family. I used to send money to my father whenever I had it, and a new house was built worth one hundred thousand pounds. My father passed away to the mercy of Allah. After his death, my brothers demanded their inheritance from me, so I informed them that their inheritance is from the value of the ten thousand pounds. However, they informed me that they have the right to the value of the new house. Do they have the right to demand from me what I earned from my travel and absence from my children and my homeland for years?
Please guide us, may Allah reward you with good.

Answer:
We advise you to reconcile with them. We advise you to reconcile with your brothers and the heirs, for reconciliation is better, and it brings peace of mind and eliminates enmity. If they refuse, then the Islamic ruling is that you and your brothers should seek judgment from one of the scholars known for knowledge and virtue, who will judge between you. The matter should be examined according to the Islamic ruling, because the courts you have do not rule by the Shari'ah. Therefore, you must seek judgment from your brother scholars who are known and who rule by the Shari'ah. However, reconciliation is better for you if you all agree and you give them some of what satisfies them, and the problem is resolved; that is better for you and preferable. I advise you of this. I advise you and your brothers to reconcile between yourselves and to settle the matter so that you do not need anyone to judge between you.
