Taking money from one of the disputing parties for himself

Machine translationRead the Arabic original
Fatwa number ( 2889 )
Q1: My father works in the police in Egypt , and it is incumbent upon him to
meet with people, investigate their problems and violations, reconcile them, and settle their disputes whenever he can. In return for this, he receives money from these people in addition to his monthly salary
, which does not cover our essential needs, but is actually less than that. What is the ruling in Islam, citing what is reported from the lives of the Companions, the Salaf, and the Tabi'un, and what is reported from the Messenger of Allah (peace and blessings be upon him) regarding this matter, so that the matter is clear for me and my family? Also, clarify for us whether I am allowed to live off this money that comes in addition to his monthly salary, since he is my guardian and I have no other source of income, and I am studying at the university? May Allah reward you with good.

A1: If your father's situation is as you described, being an employee who receives a salary for his work, but who nonetheless performs reconciliation between disputing parties who are referred to him to achieve a settlement or reconciliation, or who come to him in his work for that purpose, and then he takes money from them or from one of them in return for that—then what he takes is a bribe, and bribery is forbidden; because the Messenger of Allah (peace and blessings be upon him) said:
May Allah curse the one who gives the bribe, the one who takes the bribe, and the one who goes between them.لعن الله الراشي والمرتشي والرائش
Al-Mustadrak lil-Hakim 30:66
. It was narrated by al-Hakim from the hadith of Thawban (may Allah be pleased with him). As for your eating, clothing, and the rest of what you need from his wealth, if part of his earnings is lawful and part is forbidden, and his lawful portion is not distinguished from his forbidden portion, then it is
permissible according to the correct opinion of the scholars.

Q2: I have a brother who obtained a Bachelor's degree in Commerce from the University of Alexandria , Department of Economics, and graduated two years ago, but he has not found a good job opportunity to help him meet his needs, and besides that, he finds that the limits of Allah are not applied in his places of work. I approached a Saudi man to look for a work contract for my brother, and he said to me: The condition for providing this contract for your brother is paying a sum of (5000) Saudi Riyals. What is the ruling in that, especially since I do not possess this amount, nor does my brother?
A2: Paying a sum of money to a person in exchange for obtaining a work contract for your brother is not permissible; rather, it is one of the major sins; because it is a bribe. It is established from the Messenger of Allah (peace and blessings be upon him) that he cursed the one who gives the bribe and the one who takes it. The one who gives the bribe is the payer of the amount, and the one who takes it is the recipient. So fear Allah, and you and your brother should seek the path of lawful earnings, for whoever fears Allah, He will make a way out for him and provide for him from where he does not expect. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
