The ruling on a woman riding with a non-mahram driver alone or with a child

Machine translationRead the Arabic original
Regarding a woman riding alone out of necessity, or with a young brother who is eight years old?
Answer: It has been stated previously that it is not permissible; there must be a third person with her, a third person who is of age or a teenager, such that the seclusion is thereby removed, or another woman as a third person, meaning the passengers are three: the driver and two others, so there is no seclusion. If there is only one, the woman is in seclusion with him; because the Messenger of Allah (peace and blessings be upon him) said:
A man should not be alone with a woman, for Satan is the third among them.لا يخلون رجل بامرأة فإن الشيطان ثالثهما
Al-Mustadrak lil-Hakim 2:94
. So if there is a third person with them, whether her mother, her sister, her neighbor, the driver’s brother, or otherwise, the point is that if a third person is present, there is no harm. Yes.
The presenter: But is it a condition that he be of age?
The Shaykh: Of age or a teenager, yes, such that the seclusion is thereby removed. Yes.
The presenter: The one who is eight years old...
The Shaykh: No, he is not of age.
The presenter: Allah is the helper, Allah is the helper. May Allah reward you with good.
