Question:
It has become widespread among many fathers to consume the mahr of their daughters, citing as evidence for this the saying of the Prophet (peace and blessings be upon him):
You and your wealth belong to your fatherأنت ومالك لأبيك
. So what is your opinion, Your Eminence? And does a father have the right to take from his son's wealth whenever he wishes and however he wishes?

Answer:
It is established from the Messenger of Allah (peace and blessings be upon him) that he said to the one who came to him and said, "My father has seized my wealth," "
You and your wealth belong to your fatherأنت ومالك لأبيك
." It is also established from him (peace and blessings be upon him) that he said, "
The best of your provision is what you earn, and your children are part of what you earn.إنَّ أطيب ما أخذتُم من كسبِكم، وإنَّ أولادكم من كسبِكم

Therefore, a father may take from his son's wealth what does not harm him and what he does not need, and likewise from his daughter's wealth; based on the saying of the Prophet (peace and blessings be upon him):
It was narrated from 'Ubadah bin Samit that the Messenger of Allah (ﷺ) ruled: “There should be neither harming nor reciprocating harm.”لا ضرر ولا ضرار

. As for what harms him, it is prohibited. If he takes from his wealth or from her mahr something that the father needs, and it does not harm her or harm his male son, there is no harm in that. The son is a part of his father, so the father may take from his wealth what the father needs for his maintenance and his family if he is unable to provide for them. He may also take from his wealth in addition to what he has, if it does not harm the son due to the abundance of the son's wealth. He may also take from the daughter's wealth what does not harm her, if her wealth is abundant and taking something from it does not harm her. However, if it harms her because the mahr is small and the needs are many, he should not take anything from it, but rather leave it for her so that she can settle her affairs with it. And Allah is the One to be asked for help.
