Question:
What is the ruling on one who is ignorant of the requirement to spend the night in Mina, and he spent one of the nights of Tashreeq in Mina, but spent the second night at his camp in Muzdalifah because of fatigue from the transfer and travel, and our custom is to stay up late at night?

Answer:
If he did not find a place in Mina, meaning he sought a place in Mina and made an effort, but did not find a place, he is excused and owes nothing; because Allah says:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[Surat al-Taghabun: 16].
As for if he has a place in Mina and does not spend some of the nights there, he must give charity in the form of some dirhams, or food, to some of the poor.
As for if he leaves all the nights, the eleventh and twelfth, in Mina, and does not spend the night in Mina, or if he leaves all three; then he should slaughter a sheep, a blood sacrifice is required of him for leaving all the nights; because he left a ritual, and whoever leaves a ritual; a blood sacrifice is required of him.
