The first question, Fatwa number ( 20802 )
Q1: In the year 1417 AH, my father, my mother, my wife, and I performed Hajj. We descended from al-Ta'if on the Day of 'Arafah after passing through the miqat in the morning, and we stood at 'Arafah . Then we proceeded from 'Arafah to Muzdalifah , where we stayed overnight. We went to Makkah before dawn and prayed Fajr in Makkah . Then we went to the Jamarat and stoned the Jamarat al-'Aqabah. A terrible incident occurred in which I nearly ran someone over, were it not for the grace and mercy of Allah. We remained in Makkah because we could not find accommodation in Mina , as the great fire occurred that year. Some of our relatives searched for
a tent for us to stay in in Mina , but they did not find one, so we did not go to Mina . After stoning the Jamarat al-'Aqabah, we performed the Tawaf al-Ifadah, then we headed to al-'Aziziyah, where we rented an apartment. We did not stay overnight in Mina during the days of Tashriq. My father and I stoned the remaining Jamarat on behalf of my mother and my wife, even though my wife was able to stone them herself and requested to do so. However, we refused and asked her to let us stone on her behalf due to the crowd and for her safety. Then we stoned the Jamarat on their behalf during the days of Tashriq. We hastened our departure, and after that, we performed the Tawaf al-Wada', as our type of Hajj was Ifrad. Then we returned to al-Ta'if . My father and I slaughtered two sheep: one as charity for my safety from the incident, and the other for our stay in al-'Aziziyah in Makkah and for not staying overnight in Mina during the days of Tashriq on behalf of all of us. Are the actions we performed valid? And does slaughtering one sheep on behalf of all of us suffice for not staying overnight in Mina during the days of Tashriq , given that it was slaughtered for them in al-Ta'if , based on my father's request, and distributed to the neighbors and those entitled to it, and not in Makkah ?

A1 : If the situation is as you described in the question, then what you did is valid, and you are not required to stay overnight in Mina due to your inability to do so. As for your wife, who did not personally stone the Jamarat but was able to do so, she must offer a sacrificial animal (dam), which is sufficient in the 'Id sacrifice, to be slaughtered in Makkah and distributed to the poor. You are all required to return to Makkah and perform the Sa'y of Hajj if you did not perform it with the Tawaf al-Ifadah, because you
mentioned the Tawaf al-Ifadah in your letters but did not mention the Sa'y. Those who delegated the stoning of the Jamarat to others while they were able to stone them themselves, that does not suffice for them. Each one of them is obligated to slaughter a sheep in Makkah and distribute it to the poor of the Haram, and they must not eat any of it. What you slaughtered in al-Ta'if does not suffice, because the slaughter of the fidyah must be in the Haram . Whoever among you is unable to slaughter must fast for ten days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
