Q2: A person whose name was not mentioned, and it is said of him: that thirty years ago he married a woman and had intercourse with her on a day of Ramadan before breaking his fast while he was fasting, and he left the situation as it was for this duration, as he says – out of ignorance – then afterwards he says: I learned that this is forbidden and that it requires fasting for two months, or freeing a slave, or feeding sixty poor people. He says he is unable to fast for two months, and his financial circumstances are severe; he cannot free a slave nor feed sixty poor people. Therefore, I am raising his question to your eminence and I hope for your answer to his question so that I may convey it to him. May Allah guide you and benefit Islam and the Muslims through you, and praise be to Allah, Lord of the worlds.
A2: Whoever has intercourse during the day of Ramadan while in the state of fasting must make sincere repentance for this act, and he must abstain from food and drink for the rest of the day, and he must make up that day, and along with making it up, he must pay the expiation, which is in order: freeing a slave
who is a believer. If he does not find one or cannot afford its value, it is obligatory for him to fast for two consecutive months. If he cannot fast due to illness, old age, or otherwise, he must feed sixty poor people, giving each poor person one and a half kilograms of wheat, rice, or the staple food of the country. If he cannot do that, it is dropped from him; because he is excused in that. And what indicates this is what came in (al-Bukhari and Muslim) and others from Abu Hurayrah (may Allah be pleased with him) who said:Bulugh al-Maram 5:28 And the Prophet did not order him to pay another expiation if he was able to, nor did he mention to him that it would remain in his debt, so that indicates its dropping when one is unable to pay it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

A man came to the Messenger of Allah (ﷺ) and said, “l am ruined O Messenger of Allah (ﷺ)!" The Messenger of Allah (ﷺ) asked him, “What has ruined you?" The man replied, ‘I had intercourse with my wife during the day in Ramadan while fasting)’ The Prophet said to him, "Are you able to free a slave?" The man said, ‘No.’ The Prophet said, "Can you fast for two consecutive months?" He said, ‘NO.' The Prophet then asked him, "Can you provide food for sixty poor people?" He said, ‘No.’ Then the man sat down. A basket of dates was brought to the Prophet and he said to the man, “Give this as Sadaqah (voluntary charity)” The man said, ‘To someone who is poorer than us!’ There is no one in this city (Al-Madinah) who is in need of these dates more than us!’ The Prophet laughed until his molar teeth could be seen and said to the man, “Go and feed your family with these dates.”
جاء أعرابي إلى النبي صلى الله عليه وسلم فقال: هلكت، قال: " وما أهلكك؟ " قال: وقعت على امرأتي في رمضان، قال: " هل تجد ما تعتق رقبة؟ " قال: لا، قال: " فهل تستطيع أن تصوم شهرين متتابعين؟ " قال: لا، قال: " فهل تجد ما تطعم ستين مسكينًا؟ " قال: لا، ثم جلس فأتى النبي صلى الله عليه وسلم بعرق فيه تمر، فقال: " تصدق بهذا "، فقال: أعلى أفقر منا؟ فما بين لابتيها أهل بيت أحوج منا، فضحك النبي صلى الله عليه وسلم حتى بدت نواجذه، قال: " اذهب فأطعمه أهلك "
