Q1: What is the ruling on entering the Noble Makkah without entering the state of ihram after being absent from it for forty days , and what is the authenticity of the hadith regarding this: that whoever enters it without entering the state of ihram after forty days is a sinner against Allah the Exalted and His Messenger (peace and blessings be upon him)?
A1 : There is no harm in entering Makkah without entering the state of ihram for one who does not intend to perform Hajj or 'Umrah; because when the Prophet (peace and blessings be upon him) designated the miqat boundaries, he said:Sahih Muslim 1181a This indicates that it is permissible for one who does not intend to perform Hajj or 'Umrah to pass them without entering the state of ihram
