Q1: I have a brother who was involved in an accident and became unable to stand, walk, or even take care of himself. His body is sound, and his mind and memory are good, except that he is often forgetful. His mother hired a person to perform Hajj on his behalf. Is it permissible to perform Hajj on behalf of a living person? Does this discharge his obligation of Hajj, or must one of his relatives perform it on his behalf?
A1 : If your brother is unable to perform Hajj himself and his incapacity is permanent and not expected to end, he should appoint someone to perform Hajj on his behalf, based on the hadith
The man who asked the Prophet (peace and blessings be upon him) whether he could perform Hajj on behalf of his father, who was unable to stay on the mount, and the Prophet (peace and blessings be upon him) said to him: Perform Hajj on behalf of your father and perform 'Umrah.الرجل الذي سأل النبي صلى الله عليه وسلم أن أباه لا يستطيع الثبات على الراحلة: هل يحج عنه؟ فقال له النبي صلى الله عليه وسلم: حج عن أبيك واعتمر
. If someone else, whether a relative or not, performs Hajj on his behalf with his permission, there is nothing wrong with it, based on the aforementioned hadith. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
