And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the head of the FIFAH Center , No. 147, dated 2/9/1419 AH, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with No. (5590) dated 8/9/1419 AH. It was accompanied by a letter from his Excellency containing the inquiry submitted by H. A. M. M., which reads as follows: Since the year 1413 AH, I have performed the obligatory Hajj with my wife with the intention of
tamattu' for myself and my wife. I was with my colleagues this year, who are more senior than me in the Kingdom. Naturally, we were required to offer the hady for myself and my wife. They told me: It is better to pay through the bank. So we went to the bank, but they did not accept any amounts from me. Then we went to the slaughterhouse, but we were unable to buy the hady because the merchants exploited the circumstances and raised the prices more and more. So we performed the rest of the obligation. Some people told us: It is sufficient for you to slaughter in your home country and distribute it to the poor. Others told me: Fast for ten days. And indeed, after returning from performing the obligation, I fasted for ten days here in the Kingdom, and I distributed two sacrificial animals in my home country, Egypt, to the poor and the family together. But until now, I have not been at ease, because I know that I was supposed to fast three days in Makkah and seven days after Hajj, but the circumstances of work and study prevent us from waiting in Makkah , because we are in a hurry. So, in any case, I would like to know now: Should I go to Makkah and buy two hady for myself and my wife and distribute them to the poor of Makkah, or should I go to perform the obligatory Hajj this year alone and slaughter two hady for myself and my wife during Hajj? What is the most correct and best in your opinion? Please clarify this for me, and what is best so that my Hajj and my wife's Hajj are accepted and free from any blemish? May Allah reward you with all good. And can the husband slaughter on behalf of his wife, or does she have to go with me? After the Committee's study of the inquiry, it answered: If the situation is as you described, that you were unable to obtain the hady for tamattu' after searching for it, and that the banks that act on behalf of pilgrims to purchase the hady for them did not accept it, due to the high prices of the hady, then in this case you are unable to offer the hady, and fasting is sufficient for you in its place. And what you did by fasting for ten days after returning to your place of residence is sufficient for you, if Allah wills, and there is no blame on you for that, and no fidyah is required of you. As for your concern about not fasting three days during Hajj on the days of the rituals and seven days when you return to your place of residence, as Allah mentioned in His Noble Book, that is the more preferable, more complete, and better option for hastening to clear one's conscience of it, and it is a dispensation from Allah. And since that was not facilitated for you due to the tightness of time and your commitment to work and travel with your group, there is no blame on you for fasting the ten days after returning to your place of residence, and that does not affect the completeness of your Hajj, if Allah wills. Likewise, your wife must fast ten days for leaving the hady if she has not fasted them after her return, and that is sufficient for her, and no fidyah is required of her, and her Hajj is complete, if Allah wills. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
