Q: Allah the Exalted commanded in His Book that one who performs tamattu' from 'Umrah to Hajj should offer what is easy of the sacrificial animals, and that one who does not find them should fast three days during Hajj and seven when he returns to his homeland. If a person is in a state where he cannot fast and does not find the sacrificial animal, do we analogize him to the one about whom Allah said:
And upon those who are able [to fast, but with hardship] - a ransom [as substitute] of feeding a poor personوَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ
[Al-Baqarah 2:184]
and have him feed a poor person for each day? Please inform us, and may Allah reward you with the best reward.

A: The one who performs tamattu' from 'Umrah to Hajj and is not among those present in the Sacred
Mosque
must pay the fidyah for tamattu' that Allah specified in the Noble Qur'an, which is slaughtering a sheep that is valid for the 'Id sacrifice in Mina or in Makkah , or one-seventh of a camel, or one-seventh of a cow. If he cannot do so, he must fast ten days: three during Hajj and seven when he returns to his family. If he cannot fast, the fidyah remains a debt in his liability, and feeding does not suffice for it; because there is no evidence for this, and it is not valid to analogize him to the one who is unable to fast Ramadan due to a continuous inability, because the operative causes of the two rulings differ. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
