Q: I performed Hajj twenty years ago with a colleague. Our intention regarding the Hajj was to fast or pay the expiation there. When we arrived in Makkah , we performed 'Umrah, then went to al-Ta'if for several days, and then returned to Makkah and performed the obligatory Hajj in full. However, we did not fast or perform the expiation; because a colleague said at the beginning that we would pay the expiation, we did not fast in the first days. Likewise, we did not perform the expiation because the money we had was not enough to buy the expiation. Therefore, we were unable to fast or pay the expiation. In Makkah , we distributed some grain to the birds of the Haram for about three days; half a sa' for each day. Then we returned to al-'Ula, and I slaughtered a sheep and invited the neighbors to eat from it, intending it as compensation for the days I did not fast or the expiation there. I ask you to kindly answer my question in detail, and what I must do. May Allah reward you with good, and peace be upon you.
A: After the Committee studied the question, it answered that the sacrificial animal is obligatory for the one performing tamattu' and the one performing qiran. It is a sheep that is sufficient as an 'Id sacrifice, or a seventh of a cow or a camel. Whoever does not find it must fast for ten days: three during Hajj and seven when he returns to his family. It is better for these days to be the sixth, seventh, and eighth of Dhu al-Hijjah, which is a forbidden month. If that is not possible, he fasts on the eleventh, twelfth, and thirteenth of the days of Tashriq. As for your action of slaughtering the sheep in your country, and likewise feeding the birds grain in
the Haram , it is not sufficient. You must slaughter a sheep that is sufficient as an 'Id sacrifice in Makkah as a make-up, to be distributed to the poor of the Haram . You may eat from it. If you are unable to do so, you must fast for ten days in your country. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
