Fatwa number ( 17012 )
Q: I am a woman who is 26 years old. I got married about thirteen years ago, and when I got married, I was 13 years old. At that time, I had not yet reached puberty. A year after my marriage, my husband and I went to Makkah al-Mukarramah and performed 'Umrah, but I was menstruating. I should mention that I was not praying, not fasting, and was "illiterate." I performed tawaf around the Ka'bah seven times with my husband, and I performed sa'i while I was menstruating. Now I am confused about what I should do. Do I have to pay an expiation or a ransom? Is repentance obligatory in this matter? And is there a sin on me for performing tawaf around the Ka'bah while I was menstruating? Please advise us, may Allah reward you with good.
A: If the situation is as you described, that you performed 'Umrah after reaching puberty and performed tawaf and sa'i while you were menstruating, and that you were not performing the prayer or
fasting before that, then your 'Umrah is invalid from its origin; because leaving off the prayer is disbelief, and no act of worship is valid while it is being left off. It is obligatory for you to repent to Allah from this great crime, and to establish the five prayers in their times, to fast the month of Ramadan, to perform Hajj to the Sacred House of Allah as the Hajj of Islam, and to perform 'Umrah, as well as the other legislations of Islam after repentance. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
