Q: We went for 'Umrah in the month of Ramadan last year, 1415 AH, my family and I, consisting of 15 individuals, and we entered the state of ihram from the miqat, and before we performed the 'Umrah, news reached us of the death of one of our relatives, and due to the suddenness of the situation and the horror of the tragedy, we all undid our ihram , and we returned to the region where we reside
in order to attend the burial and the condolences, knowing that we did not make a condition when we entered ihram, and we would like to know what the ruling is in this matter, and what is obligatory upon us? And because I have sought the opinion of a number of shaykhs, who clarified in different fatwas that left me in confusion about my affair, I ask you to please clarify the ruling in this matter, knowing that we undid the ihram and returned out of our ignorance of the ruling in this matter, and may Allah reward you with the best reward.
A: What you did is an error, and it is obligatory upon all of you to put on the clothes of ihram again, and to refrain from its prohibitions, and to return to Makkah and perform the 'Umrah for which you entered ihram, along with repentance to Allah (Glorified and Exalted is He) for what you did; because whoever enters ihram for a Hajj or 'Umrah ritual, it is obligatory upon him to perform it; due to the saying of Allah the Exalted:[Al-Baqarah 2:196] and it is not permissible for him to refuse it. And if someone engaged in sexual intercourse during this period, it is obligatory upon him to continue with the 'Umrah until he completes it as we mentioned, then he returns to the miqat from which he first entered ihram and enters ihram for a new 'Umrah to make up for the 'Umrah he invalidated with the intercourse, and he slaughters a fidyah, which is a sheep that is sufficient as an 'Id sacrifice, which he slaughters in Makkah , and he distributes it to the poor of the Haram.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
