The first question of Fatwa No. ( 19405 )
Q1: Through my interaction with women, especially my female relatives, and during the exchanges of visits between us, some of them give me certain items or gifts, whether financial or beneficial. At that point, I swear by Allah that I will not take anything from them, but they compel me to take them even though I have sworn by Allah. So sometimes I fast three days as expiation for this oath or debt, and sometimes I say: Indeed, Allah is Forgiving and Merciful, and He will not hold me accountable for such a simple oath that
we have become accustomed to in our general lives. I ask you, O honorable Shaykh, to issue a ruling on this matter, and may Allah reward you a thousand times over.

A1: If you swear by Allah regarding a future matter that you will not take anything, then it is considered one of the binding oaths that must be adhered to, if adhering to it is obedience to Allah. However, if adhering to it involves disobedience to Allah and His Messenger, or if you see that something else is better than it, then you may break your oath by contradicting what you swore to; based on the saying of the Messenger (peace and blessings be upon him):
Whoever vows to obey Allah, let him obey Him, and whoever vows to disobey Allah, let him not disobey Him.من نذر أن يطيع الله فليطعه، ومن نذر أن يعصي الله فلا يعصه

, and his saying (peace and blessings be upon him):
Whoever swears an oath, then sees something better than it, let him do that which is better.من حلف على يمين فرأى غيرها خيرًا منها فليكفر عن يمينه وليأتِ الذي هو خير

. Accordingly, if you contradict what you swore to, you are required to pay the expiation for an oath for every oath you swore, provided that their implications are not the same. But if their implication is the same, meaning the thing sworn upon is one, and you have not broken the previous ones, then one expiation suffices for all of them. It is: feeding ten poor people, with each poor person receiving one and a half kilograms of food, whether wheat, rice, or the like of what is the staple food of the country, or clothing them, or freeing a believing slave. If you are unable to do all of that, you move to fasting for three days; based on the saying of Allah the Exalted:
Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. So its expiation is the feeding of ten needy people from the average of that which you feed your [own] families or clothing them or the freeing of a slave. But whoever cannot find [or afford it] - then a fast of three days [is required]. That is the expiation for oaths when you have sworn. But guard your oathsلاَ يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُوا أَيْمَانَكُمْ
[Al-Ma'idah 5:89]

the verse, and it is not befitting for a Muslim to be negligent regarding the matter of oaths, so he should not expiate for his oath after breaking it, nor should he multiply oaths without need; because Allah the Exalted says:
And keep your oathsوَاحْفَظُوا أَيْمَانَكُمْ
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
