Q: I present to your Eminence that my husband, after I had given birth to two children from him, I was breastfeeding the second child, and he would tie my hands behind my back and force me to breastfeed from both my breasts, and he habituated himself to breastfeeding from me for four months, and he declared to me by saying, "You are like my mother," and after this he brought me on a visit
to my family and I declared to my family what he did of breastfeeding from my breast until he sucked it all, so is this action of his lawful or forbidden, and what is the ruling?

A: Your husband’s action is not permissible for him, and it is obligatory for him to leave it and not return to it, but it does not make you forbidden to him; because the breastfeeding that makes a woman forbidden is what occurs within the two years; due to his saying (peace and blessings be upon him):
as fostership is only valid if it takes place in the suckling period (before two years of age).إنما الرضاعة من المجاعة

, and his saying (peace and blessings be upon him):
The only suckling which makes marriage unlawful is that which is taken from, the breast and enters the bowels, and is taken before the time of weaning.لا يحرم من الرضاع إلا ما فتق الأمعاء وكان قبل الفطام

, and based on that, you are not forbidden to him, and his saying to you: (You are like my mother) if he intends by it breastfeeding, then it is not correct, and if he intends by it zihar, then it is obligatory for him to pay the expiation, which is freeing a slave, and if he does not find one, he fasts two consecutive months, and if he cannot do that, he feeds sixty poor people; due to His saying (Glorified and Exalted is He):
(3) And those who pronounce thihar from their wives and then [wish to] go back on what they said - then [there must be] the freeing of a slave before they touch one another. That is what you are admonished thereby; and Allah is Acquainted with what you do. (4) And he who does not find [a slave] - then a fast for two months consecutively before they touch one another; and he who is unable - then the feeding of sixty poor persons.وَالَّذِينَ يُظَاهِرُونَ مِنْ نِسَائِهِمْ ثُمَّ يَعُودُونَ لِمَا قَالُوا فَتَحْرِيرُ رَقَبَةٍ مِنْ قَبْلِ أَنْ يَتَمَاسَّا ذَلِكُمْ تُوعَظُونَ بِهِ وَاللَّهُ بِمَا تَعْمَلُونَ خَبِيرٌ (3) فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ مِنْ قَبْلِ أَنْ يَتَمَاسَّا فَمَنْ لَمْ يَسْتَطِعْ فَإِطْعَامُ سِتِّينَ مِسْكِينًا
[Al-Mujadila 58:3-4]
