Q: A woman’s husband passed away a long time ago, approximately forty-seven years (47). When he died, he had no money for his wife to spend on herself, he had no family, he had no money, and he had no heirs. No one told her that she was required to observe a waiting period of four months and ten days for the sake of the deceased’s marriage bond. The people at that time were ignorant. Today she asks: Is it obligatory for her to observe mourning, or is there an expiation, or is it forgiven? Please issue a ruling for us. May Allah reward you with good.
A: The waiting period is obligatory by the Shari'ah and does not require an intention. It takes effect immediately after its cause, such as death or other causes. Mourning is obligatory for the wife of the deceased, and she commits a sin by leaving it off. However, there is no expiation required of her for leaving off the mourning. Therefore, she should increase her repentance and seeking of forgiveness, and do good deeds. Based on this, her waiting period has been fulfilled by the passage of the mentioned duration. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
