Q1: What is the ruling on a woman whose husband has died and who refuses to observe the mourning period, what is the evidence for this?
A1: It is obligatory for a woman whose husband has died to observe the waiting period and the mourning period. As for the waiting period, it is four months and ten days for a woman who is not pregnant, and the duration of pregnancy for a woman who is pregnant, and she exits the waiting period by giving birth. The basis for this is the saying of Allah the Exalted:
And those who are taken in death among you and leave wives behind - they, [the wives, shall] wait four months and ten [days]وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا
[Al-Baqarah 2:234]

And the saying of Allah the Exalted:
And for those who are pregnant, their term is until they give birthوَأُولاتُ الأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ
[At-Talaq 65:4]
As for the mourning period, it is obligatory upon her during the duration of the waiting period. Ibn Qudamah said: "We do not know of any disagreement among the scholars regarding its obligation upon a woman whose husband has died, except from al-Hasan , who said: 'The mourning period is not obligatory.' This is a view that deviated from the scholars and contradicted the Sunnah, so it is not to be followed. End of quote. If she leaves it off, she will be sinful for that, and she must repent to Allah, the Exalted, from it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
