Question 32 and 40 from Fatwa No. ( 12087 )
Q 32: Is it permissible to eat in restaurants that serve intoxicants ?
A 32 : If it is easy for him to eat elsewhere, it is not permissible for him to eat there; because of the cooperation with them in sin and transgression that is involved in that, and Allah the Exalted has forbidden
that, and if it is not easy to eat elsewhere, it is permissible for him to eat there out of dire necessity; due to His saying:
and has not placed upon you in the religion any difficultyوَمَا جَعَلَ عَلَيْكُمْ فِي الدِّينِ مِنْ حَرَجٍ
[Al-Hajj 22:78]
and His saying:
Allah does not charge a soul except [with that within] its capacityلاَ يُكَلِّفُ اللَّهُ نَفْسًا إِلا وُسْعَهَا
[Al-Baqarah 2:286]
but he does not eat or drink except what Allah has made lawful.
