Fatwa No. ( 18751 )
Praise be to Allah alone, and may blessings and peace be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the Honorable Assistant Head of the 'Asir Region Courts, by proxy, with number (1843) and date 7 \ 4 \ 1417 AH, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (1959) and date 11 \ 4 \ 1417 AH. His Eminence asked a question, the text of which is as follows: I attach to Your Eminence a letter from the Director of the Abha Hospital for Women and Childbirth and Health Centers, number (2188) dated 7 \ 4 \ 1417 AH, in which he presented the case of their patient (F. M. S. Q.), for whom the medical committee determined that she is unable to bear children in the future, and decided to terminate her pregnancy by performing a tubal ligation. The woman and her husband have agreed to this. Given the issues involved in preventing
pregnancy, I submit this matter to your attention. I request your kind review and guidance with what you deem appropriate. The text of the medical report is as follows: Patient name: (F. M. S. Q). Age: 33 years. Nationality: Saudi. Gender: Female. Medical record number: (.. ). Address: Abha . Patient's complaint and medical history: She was referred to the Abha Hospital for Women and Childbirth by a cardiologist at the 'Asir Central Hospital. Clinical examination: She suffers from heart failure and mitral valve regurgitation, and suffers from this condition to the extent that she cannot sleep except on three pillows. She is currently approximately (40) days pregnant. She was referred to the Abha Hospital because her health condition cannot tolerate pregnancy, in addition to the fact that she is taking warfarin tablets, which may affect the formation of the fetus in the early stages of pregnancy, potentially resulting in deformities. Diagnosis:
The local medical committee, after the approval of His Excellency the Judge of the Sharia Court and the husband's desire to terminate this pregnancy, and the report of the cardiologist stating that the patient's condition cannot tolerate pregnancy, and obtaining the husband's consent that performing surgery in this case is dangerous, the committee recommends performing a tubal ligation along with terminating the pregnancy .

.

After the Committee's study of the inquiry, it answered as follows: Based on what is contained in the report signed by a number of doctors, there is no objection to terminating the pregnancy and performing a tubal ligation to prevent future pregnancy for the reasons mentioned in the report. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his companions.
