Fatwa No. ( 109 )
Q: A quarrel occurred between me and my wife, which led to me divorcing her with a divorce in accordance with the Sunnah on 18/2/1392 AH. On 22/2/1392 AH, I wished to take her back and regretted what came from me. I contacted her family and informed them. They gave me a ruling on this matter to present to my relatives.
A: If you divorced your wife with a divorce in accordance with the Sunnah, and you had not previously divorced her twice, then you may take her back as long as she is in the waiting period. If you take her back during the waiting period and bear witness to it, she is your wife. If you have not taken her back now, take her back and bear witness to the taking back with two just witnesses, provided her waiting period has not ended. If her waiting period has ended and you have not taken her back, she is not lawful to you except with a new contract and a new bridal gift, with her consent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
